Terms of Service

By accessing or using Call Compass ("the Service"), operated by Tidewater Research ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Service.

You must be at least 18 years old and have the legal capacity to enter into contracts to use our Service.

2. Description of Service

Call Compass provides AI-powered conversation analysis and quality assurance tools, including:

  • Automated evaluation of call recordings and transcripts
  • Custom rubric creation and management
  • Performance reporting and analytics
  • Team coaching capabilities
  • Integration with various file formats and systems

3. User Accounts

Account Creation

To use our Service, you must:

  • Provide accurate and complete registration information
  • Maintain the security of your account credentials
  • Promptly update any changes to your information
  • Accept responsibility for all activities under your account

Account Security

You are responsible for maintaining the confidentiality of your account credentials. Notify us immediately of any unauthorized access or security breach.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any regulations
  • Upload content that infringes on intellectual property rights
  • Attempt to gain unauthorized access to our systems
  • Interfere with or disrupt the Service or servers
  • Use automated systems or software to extract data without permission
  • Resell or redistribute the Service without authorization
  • Upload malicious code or harmful content

5. Content and Intellectual Property

Your Content

You retain ownership of all content you upload to the Service. By uploading content, you grant us a limited license to:

  • Process and analyze your content to provide the Service
  • Store and backup your content for service continuity
  • Generate insights and reports based on your content

Our Intellectual Property

The Service, including its design, features, and content (excluding user content), is owned by Tidewater Research and protected by intellectual property laws. You may not copy, modify, or reverse engineer any part of the Service.

6. Payment Terms

For paid subscriptions:

  • Fees are charged in advance on a monthly or annual basis
  • All payments are processed securely through Stripe
  • Prices may be updated with 30 days notice
  • No refunds for partial periods, except as required by law
  • You authorize automatic renewal unless cancelled

Free tier usage is subject to the limits specified in our pricing plans.

7. Disclaimers and Limitations

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee:

  • Uninterrupted or error-free service
  • Accuracy or completeness of AI-generated analyses
  • Fitness for any particular purpose

Our liability is limited to the amount you paid for the Service in the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential damages.

8. Indemnification

You agree to indemnify and hold harmless Tidewater Research from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any rights of another party.

9. Termination

We may terminate or suspend your account immediately, without prior notice, for:

  • Breach of these Terms
  • Fraudulent or illegal activities
  • Non-payment of fees
  • Actions that harm other users or the Service

You may terminate your account at any time through your account settings. Upon termination, your right to use the Service ceases immediately.

10. Governing Law

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Richmond, Virginia.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use after changes constitutes acceptance of the modified Terms.
